Terms of service

These terms cover your use of NightHerald, which helps nightlife promoters and artists plan and publish event promos on Facebook and Instagram. Our privacy policy explains how we handle your data.

  1. 1. Who can use it

You must be 18 or older and able to agree to these terms. If you use NightHerald for a business, such as a promotion company or venue, you agree to them for that business too.

  2. 2. Your account

Keep your password safe and your details accurate. You're responsible for what happens under your account. Tell us right away if you think someone else has used it.

  3. 3. Your content

Flyers, photos, captions and event details you add stay yours. You give us permission to store, resize and publish them only as needed to run your campaigns. You must have the rights to everything you upload and to every artist, venue and brand you name or tag.

  4. 4. Facebook and Instagram

When you connect a Page or Instagram account, you confirm you're allowed to post for it. NightHerald publishes only the posts you schedule. Your use of those platforms is also covered by Meta's own terms, and Meta can reject, delay or remove posts. NightHerald isn't made by or affiliated with Meta.

  5. 5. Acceptable use

Don't use the service to post spam, misleading or illegal content, or content that infringes someone else's rights. Don't try to break, overload or get around the security of the service, or access accounts that aren't yours.

  6. 6. Beta and availability

NightHerald is in an early pilot. Features may change, and we can't guarantee that every post goes out on time or exactly as previewed. Pilot users also agree to the beta tester terms. See the beta tester terms.

  7. 7. No warranties

The service is provided as is and as available, without warranties of any kind. To the extent the law allows, NightHerald isn't liable for indirect or consequential losses, such as lost ticket sales, and our total liability is limited to what you paid us in the 12 months before the claim.

  8. 8. Ending your account

You can stop using the service and ask us to delete your account at any time. We may suspend or close accounts that break these terms.

  9. 9. Changes

We may update these terms. We'll change the date below and email signed-up users about significant changes. Using the service after a change means you accept it.

  10. 10. Governing law

These terms are governed by the laws of the State of North Carolina, USA.
